Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website stjosephsconvent.org ("the Site") and any donation, engraving or related service offered through it. The Site is operated by St Philomena School Ltd. ("the School"). By accessing the Site or submitting a donation request you agree to be bound by these Terms.

1. Scope of these Terms

These Terms of Use apply solely to the Engrave a Brick fundraising activity conducted by St Philomena School in support of the St Joseph's Convent project, and to use of this website (stjosephsconvent.org).

They do not apply to, and do not govern, the general operations, enrolment, pastoral, educational or other activities of St Philomena School. Those activities are subject to separate terms and policies available from the School Administration.

2. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Queensland, Australia. You and the School submit to the exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia in respect of any dispute arising out of these Terms or your use of the Site.

3. About the Fundraiser

The Site facilitates donations to the St Joseph's Convent Fundraiser, which supports the construction of a traditional Catholic convent for the Sisters of the Society of St Pius X (SSPX) on the grounds of St Philomena School, Park Ridge, Queensland.

4. Donations

  • Donations are made by bank transfer to the account displayed on the Site. The form on the Site is a reservation and notification, not a payment facility.
  • Each donation is assigned a unique payment reference code which must be quoted on the bank transfer. Failure to include the reference may delay or prevent reconciliation of your donation.
  • Tax-deductibility is subject to the School's endorsement status with the Australian Taxation Office. Tax receipts will be issued once payment is received and reconciled.
  • Donations are voluntary and, once made, are generally non-refundable. Refund requests in exceptional circumstances (duplicate payments, processing errors) will be considered on a case-by-case basis.

5. Engraving Content — Sole Discretion of the Principal

The School reserves the absolute and unfettered right, exercised at the sole discretion of the School Principal, to reject, modify, or decline to engrave any text, name, symbol or content submitted through the Site which, in the Principal's sole judgment:

  • Does not align with the values, mission, faith or teaching of the School and the Society of St Pius X;
  • Is inconsistent with Traditional Catholic doctrine, morals or sensibility;
  • Is profane, offensive, obscene, vulgar, defamatory, discriminatory or otherwise inappropriate;
  • Promotes any person, organisation, commercial interest, ideology or message that the Principal considers incompatible with the School's character;
  • Misrepresents, impersonates, or may reasonably cause confusion as to the identity or affiliation of the person commemorated;
  • Infringes any intellectual-property right or right of publicity; or
  • Is otherwise, in the Principal's sole judgment, unsuitable for a place of worship, education or prayer.

The decision of the School Principal in respect of any engraving content is final and not subject to appeal. Where an engraving is rejected the School will contact the donor to propose an amended wording. If no mutually acceptable wording can be agreed, the donation may, at the School's discretion, be refunded or treated as a general gift to the fundraiser without engraving.

6. Character Limits and Technical Constraints

Engravings are subject to character-limit and layout constraints published on the Site. Final engraved appearance will vary from on-screen previews due to the physical nature of the stone, masonry tolerances and the engraving process.

7. Installation and Timing

Installation of engraved bricks is contingent on the progress of the building project, sufficient donations being received, and the availability of the engraver. The School does not guarantee a specific installation date and shall not be liable for any delay.

8. Acceptable Use of the Site

You agree not to:

  • Use the Site for any unlawful, fraudulent or malicious purpose;
  • Attempt to interfere with the Site's operation, security, or tamper-detection mechanisms;
  • Submit false, misleading or bot-generated donations;
  • Reverse engineer, scrape, or access the Site other than through its normal user interface;
  • Use the Site to transmit spam, malware, or unsolicited communications.

9. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, the St Philomena School crest, and design elements — is owned by or licensed to the School and is protected by Australian and international copyright law. You may not reproduce, distribute, or create derivative works without prior written permission.

10. Third-Party Services

The Site relies on third-party services (including Formspark, GitHub Pages, Cloudflare and Google Fonts). The School is not responsible for the availability, performance or practices of these services. Your use of third-party services is governed by their own terms and privacy policies.

11. Disclaimer of Warranties

The Site is provided "as is" and "as available". To the maximum extent permitted by Australian law, the School makes no warranties, express or implied, regarding the operation, accuracy, completeness or fitness for purpose of the Site.

12. Limitation of Liability

To the maximum extent permitted by law, the School, its officers, employees, volunteers and agents shall not be liable for any indirect, incidental, consequential or special damages arising out of or in connection with your use of the Site. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.

13. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookies Policy, which are incorporated by reference into these Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remainder of the Terms shall continue in full force and effect.

15. Changes to These Terms

The School may amend these Terms from time to time. The effective date at the top of this page will indicate when the current version was published. Continued use of the Site after changes are published constitutes acceptance of the amended Terms.
